1. DEFINITIONS AND INTERPRETATION
1.1 For the purpose of these terms and conditions the following expressions shall bear the meanings assigned to the below:
a. “Annual Fee” the annual membership subscription fee as set out in the schedule;
b. “Spa” The Spa at Armathwaite Hall situated within the Armathwaite Hall Country House Hotel, Bassenthwaite Lake, Keswick, CA12 4RE;
c. “Commencement Date” the date the Member’s application for Membership has been accepted by The Spa as set out in The Schedule;
d. “Joining Fee” the Membership joining fee as set out in The Schedule;
e. “Manager” the manager of The Spa;
f. “Member” the person whose name is on the Membership Form who hereby agrees to become a member of The Spa on the terms and conditions hereunder;
g. “Membership” the Member’s membership of The Spa on the terms and conditions hereunder;
h. “Membership Fee” the Monthly Fee or the Annual Fee as the case may be;
i. “Monthly Fee” the monthly membership subscription fee as set out on the schedule;
j. “Proprietor” Armathwaite Hall Hotel Limited (Company Number 1279666) “schedule” the attached schedule of membership details.
1.2 Any reference to one gender shall include reference to the other gender.
2. ACCEPTANCE AS A MEMBER
a. The Proprietor has absolute discretion as to whether to accept any application for Membership. If an application for Membership is accepted by the Proprietor, Membership shall commence on the Commencement Date.
b. Upon application for Membership the prospective Member will complete a Health and Lifestyle questionnaire. Upon acceptance for Membership, the Member shall be issued free of charge with a membership card personal to him, a Gym USB wrist band and shall be entitled to the rights and privileges exercisable by the class of Membership for which his application has been accepted. Entry to the Spa is gained on presentation of a valid membership card by the relevant member.
c. Acceptance by the Proprietor of an application for Membership shall constitute a binding contractual arrangement between the Proprietor and the Member upon these terms and conditions.
3. LIMITATION OF LIABILITY
In consideration of The Spa accepting the Member’s application for Membership and becoming and remaining a Member of The Spa, the Member agrees that neither the Proprietor, the employees, or agents of the Proprietor shall be liable for any loss or damage to or theft of personal property to the Member or any guest of the Member occurring upon The Spa premises.
All Members use The Spa at their own risk. The Spa cannot accept liability for any illness or injury which results from the use of The Spa’s facilities by Members other than liability which may result from proven negligence of The Spa
4. PHYSICAL CONDITION OF MEMBER
The Member warrants and represents that he is in good physical condition and that he is capable of engaging in active and passive exercise and that such exercise would not be detrimental to health, safety, comfort or physical condition. The Member will visit his/her GP before taking part in any physical activity provide by The Spa. Each new member will be invited for a Mini Fitness Assessment and Gym Induction as part of their joining package. Members are required to inform The Spa of any changes to their physical/medical condition.
5. ASSIGNMENT
Membership of The Spa is personal to member. The Member shall not loan his membership card to any other person or permit it to be used by anyone other than the Member.
6. CONSTITUTION
The Spa is a proprietary spa owned the Proprietor.
7. MEMBERSHIP
a. Members should be over 18 years of age, unless part of a Family Membership. Children under the age of 18 years must be accompanied by an adult in The Spa at all times. Children may use pool facility between 8.30am-10am and 4.30pm-6pm Monday to Saturday and 8.30am-10am and 2.00pm-6.30pm on Sunday. They must have vacated the pool area by the end times. Children over 12 years are permitted to use the out door hot tub if accompanied by an adult. The Spa treatment area and thermal suite are unavailable to anyone under the age of 18 years.
b. All Members are required to complete a Health and Lifestyle Questionnaire when they apply for Membership.
c. All Members are required to abide and adhere to The Spa Rules and Regulations. Such Spa rules and regulations are displayed within The Spa and a copy of such rules and regulations is available to all Members upon request to a member of The Spa staff.
d. Member’s must inform The Spa of any changes to their personal details
e. Treatment and selected fitness activities incur an additional charges as published in our Spa Treatment and Activities Price List.
Advanced bookings are required for beauty treatments, personal training and health and fitness assessments. To cancel a booking at least 48 hours notice is required. If you (or your guests) cancel any appointment with less than 48 hours notice or fail to attend an appointment a cancellation fee will incur for the full cost of the treatments or activities booked. A credit card number will be required to secure treatment reservations.
f. The Spa is a non smoking environment.
g. The Spa provides lockers for daily usage only. Items left overnight
will be removed and held by The Spa for one week only. Property stored in the lockers is stored at the owners own risk.
h. All areas of The Spa are mobile phone free zones and all phones must be switched off upon entering The Spa.
i. The Spa provides towels on a complimentary basis. Towels should be collected from and returned to The Spa Reception. Robes will be available for a nominal rental fee.
8. JOINING FEE AND MEMBERSHIP
SUBSCRIPTIONS
a. All Members shall pay the Joining Fee, which shall become due and payable immediately upon the Commencement Date. If a person ceases to be a Member for whatever reason and wishes to become a Member again at some later date such Member must pay the Joining Fee again at the date of re-joining The Spa and a the Joining Fee rate in force at that date.
b. All Members shall pay, as stated in the Schedule, either the Monthly Fee in advance or the Annual Fee yearly in advance, the first such relevant payment being due and payable on the commencement date.
c. The Membership Fee shall be payable by each Member irrespective of the actual usage of The Spa or change in personal circumstances.
d. The Monthly Fee shall be payable by means of a monthly Direct Debit mandate by the Members bank account.
e. Monthly and Annual Fees may be increased by the Proprietor at any time after the 1st Anniversary of the Member becoming a member of The Spa. The Proprietor shall give the Member not less than 30 days notice prior to any such increases.
f. Monthly and Annual Fees are reviewed by the Proprietor on 1st December in every calendar year. The Proprietor shall give the Member not less than 30 days notice prior to such review.
g. If a Member opts to pay their Fees by Direct Debit Mandate they can not change method of payment during their annual Membership.
h. Membership Fees and the Joining Fee are not refundable.
9. MEMBERSHIP CATEGORIES
Single Full Membership – entitles full use of The Spa leisure facilities during opening hours Couples Full Membership – entitles full use of The Spa leisure facilities during opening hours. Joint members must reside at the same address.
Off Peak Membership – entitles use of The Spa leisure facilities between 9am to 5pm Monday to Friday
Couples Off Peak Membership – entitles use of The Spa leisure facilities between 9am to 5pm Monday to Friday.
Countryside Membership – Inclusive of 12 Day passes with use of The Spa leisure facilities from 7am – 9pm.
Family Membership – entitles access to the pool facility at designated times only. All children of a family membership must be accompanied by an adult at all times.
Corporate Membership – Details available on request
10. TERMINATION OF MEMBERSHIP
a. The Proprietor/Spa Manager may terminate the membership of any Member either verbally or, if in writing, to the Member’s address set out in the Schedule, and with immediate effect.
1. In the event of a Member committing a serious or repeated breach of
these terms andconditions or The Spa Rules and Regulations;
2. If the Member gives or has given The Spa Manager, Proprietor or The Spa any fraudulent or wrongful information in order to obtain a Membership and upon any such termination all monies owing to The Spa pursuant to these terms and conditions shall become due and payable immediately and the Proprietor shall be entitled to disclose Member’s personal details as contained in the Schedule and other membership documentation, a credit reference or collection agency or any other party for the purpose of obtaining settlement of all monies owing pursuant to these terms and conditions. The Member shall also be liable for costs incurred in the settlement of such monies owing.
b. The Member may only terminate his membership by giving the Proprietor one
calendar month’s prior written notice, such notice to expire on the last day of the month after the initial 12 month period of Membership.
For avoidance of doubt all Membership Fees up to and including termination of Membership in accordance with this clause shall remain payable in accordance with these terms and conditions.
11. USE OF SPA FACILITIES
a. There are different classes of Membership which allow the Member different rights to use The Spa’s services and facilities.
b. Member’s and their guests use the swimming pools at their own risk. No running, jumping or diving in or around the pool area is allowed. The pool may be unavailable for general swimming when water based classes are taking place – notification of these times will be published in The Spa. It will be necessary for the pool to be closed at certain times without prior notification to carry out essential maintenance.
c. Any periods of services and facilities not included in a particular class of Membership may be provided to the relevant Member for an upgrade of Membership Fee which shall be at the Proprietor’s sole discretion.
d. The Proprietor reserves the right to vary, add to or remove any particular services and facilities provided by The Spa from time to time.
12. HOURS OF OPENING
a. Details of the Spa’s normal hours of operation and the hours in
which any facility within The Spa are shown in the Schedule and are available to Members upon request from The Spa Manager. Such hours may be lengthened or shortened at the entire discretion of The Spa Manager, who shall endeavour to give Members reasonable notice of the lengthening or shortening of hours.
b. The Proprietor reserves the right to close The Spa for two weeks in each calendar year for maintenance or upgrades.
13. GENERAL
a. If through circumstances beyond the control of the Proprietor or
The Spa is unable to provide the full range of services and facilities as advertised, the Member shall nonetheless remain liable to pay all Membership Fees under these terms and conditions.
b. The Proprietor reserves the right to charge a fee for the
replacement of lost and /or
damaged membership cards. If a Member loses or damages their introductory Gym Flash USB wrist band the said Member will be required to pay for a replacement at a fee issued by The Spa Manager.
